BNSS Important Definitions

Bailable and Non Bailable Offences 2(1)(c)

Bailable offences is defined in Section 2(1)(c) of the Sanhita as Follows:

Bailable offences means an offence which is shown as believable in the first schedule, or which is made available by other laws for the time being in force and

non bailable offences means any other offences.

In case of bailable offences bail can be claimed by accused as a matter of right in the court or the officer in-charge of the police station is bound to release the accused on the bail.

Summons Case 2(1)(x)

Case for non-serious Crimes, where punishment is less than 2 Years with or without fine.

Definition- Summons case means a case relating to an offence and not being a warrant case.

Warrant cases 2(1)(z)

A warrant case means a case relating to an offence punishable with

  1. death
  2. imprisonment for life or
  3. imprisonment for term exceeding two years

Cognizable offence 2(1)(g)

Offences in which police officer may arrest without a warrant

Non cognizable offences 2(1)(o)

Offences in which police officer has no authority to arrest without warrant.

In non cognizable offences police cannot investigate into the matter without a warrant of a magistrate.
